The Contractor agrees to perform the work in a competent manner according to British Standards 3998 and in compliance to the specification and quotations contained in the estimate given.

The Contractor is adequately covered by insurance and shall assume its legal liability for damage to persons for property that may result in the performance of this contract.

The Owner shall be liable for damage to underground facilities and obstructions unless the Owner gives to the Contractor in writing the exact location of such facilities before the commence of work.

Investigation of Tree Preservation orders, Private Covenants or Liability arising from the inauguration of Conservation Areas (Town and Country Amenity Act 1974) shall be the responsibility of the Owner and no liability shall attach to the Contractor for a breach of any Order of Covenant.

Any charge for the removal of power lines or telephone cables to be the responsibility of the Owner, unless otherwise agreed in writing with the Contractor.

Completion dates shall be contingent upon weather conditions.

Three months after the submission of the quotation, the Contractor reserves the right to withdraw and re-price work, unless otherwise agreed in writing on acceptance of instructions from the Owner.

Payment 7 days net from completion.
